Does MS own Linux now

Microsofts Steve Ballmer is now staying that since the agreement with Novell (that owns SuSE Linux, who do not own Linux or any other version of the Linux packaged OS) Steve / MS are now able to go after other Linux versions for patent issues.

Is this just another scare game from MS ?
