Microsoft Novell deal problems

The Microsoft and Novell deal is all about the patents for Microsoft (as Steve Ballmer has said) but there is talk within the GPL version 3 to have an statement saying that if one person has Intellectual Property (IP) rights to the code, so will all the other people who are using it. Which for Microsoft will put an massive hammer into there IP game to destroy Linux, could have been Microsoft game for them to allow the difference between the Linux kernel and other applications to join hands and use the GPL3 or was it just because they was not really understanding what GPL (3 in this topic) could include and what it means. Well at least Novell have a few hundred million from Microsoft out of the deal.
